Confused?

That’s OK!  Many commentators agree that the laws are intentionally being left in a confused state with no clear guidelines as this chaotic situation is better for music and video companies than what may possibly come in a clear, negotiated (and hard to ever change) law.

What does this mean for you as a PIO?  Be VERY careful if you ever incorporate someone else’s audio or video into your work.  It’s probably illegal, and even if you think it is “fair use,” don’t bet that a lawyer can’t and won’t be ready to argue against you and take you and your group to court.  Even if you think, “Everybody else does it,” your best bet is just don’t do it.

So when CAN you freely use material or copy PIO related things?

You CAN copy and use the news, PIO pages, backgrounders and promotional materials found on the ARRL website as long as you give attribution to the ARRL as the source and do not distort the text or intent.

The materials that the ARRL makes available to PIOs on the http://www.arrl.org/pio page and the pages branching off from it are yours to use, copy and modify in the promotion of ARRL and all Amateur Radio.  The audio, video and written materials are a service of the ARRL to you and to all hams.  All we ask in return is that you attribute where you got it in your work using it.

The ARRL staff and volunteers go to great lengths to make sure the materials there are free and clear of any and all claims on them.  That takes a lot more effort than you might expect and is also why we cannot use many of the videos, pictures and other promotional things sent into us.  If we don’t have free, clear and comprehensive permissions from everyone involved in it, then we cannot use it.
