Section 6 - Media, Hams and FCC Rules

             It's the Law

             When CAN you use material

             FCC Rules and PIOs

Goals of this section:

Identify key liability issues a PIO might face

Understand basic copyright and fair use issues

Become aware of FCC rules and newsgathering issues

It’s the Law!

The Bill of Rights is the first 10 Amendments to the US Constitution.  I hope you are aware not only that they exist, but also what they actually say. They are ALL important, but the first one is critical to you as a PIO.

“Congress shall make no law abridging freedom of speech or of the press.”  That simple statement is the basis of American news services.  It seems simple, but….  It’s NOT all that simple when acted out in the real world.  Here are a few examples that “gum up the works.”

            Press shield laws

Who or what is a “reporter” anymore?

            Privacy Acts

            Sunshine Acts

            Copyright Law

            Right to Know

            Freedom of Information Act

            HIPAA Regulations

We cannot get into all of these here, but let’s summarize a few and get them out of the way as they apply to you.
